      Hi, we’ve been refused pp for change of use of a town centre office premises to a bookies. The premises is in the centre of a smallish town (3000 pop) and had previously been an insurance co. office.

      The Co Co refused on the grounds that the proposed use would not be in keeping with the aim of retaining retail in the town centre. Given that it is currently an office surely this is also against that policy.

      Would there grounds to appeal based on the fact that it’s currently an office and not retail? (broadly speaking)

      Excerpt below from the 2001 regs. It would appear to me that if the current use as insurance sales is covered by the description ”financial services” or ”professional services(other than health or medical services) that your development would be ”exempted development” as both would be class 2 uses. If it falls under Class 3 it would be a change of use.

      CLASS 2
      Use for the provision of—
      (a) financial services,
      (b) professional services (other than health or medical services),
      (c) any other services (including use as a betting office),
      where the services are provided principally to visiting members of the public.
      CLASS 3
      Use as an office, other than a use to which class 2 of this Part of this Schedule
      applies.

      But once he has applied for PP it is no longer exempt

      Spoke with a planner in the council and he confirmed that there should not have been a need to apply for change of use planning, but as the premises is a protected structure (the facade is protected) that PP would be required for new signage etc.
