      Kerry County Council waives planning permission for HSE dispensary – 08-08-2009

      Kerry County Council says it’s making an exception to planning rules for the HSE. The health authority has set up an emergency dispensary at its offices in Denny Street while its standoff with pharmacists continues. Usually, a change of usage from an office to a retail outlet requires planning permission from Kerry County Council. In this case, however, the local authority says it understands the HSE must provide emergency cover to ensure that the public can get their medicine. As a result, the county council does not intend to take any action in the short term. It added it will continue to monitor the situation.

      Can Kerry Co Co do this?
      Are they not bound by planning law?
      Is this illegal?
