    Just looking at the scheme of charges for the appeal, as far as I can see the appeal costs €210 but it says that oral submissions are €90, does that mean that I can just apply to state my case orally instead of having to explain it all in writing?

    I’ve just had a look at the Bord Pleanala website to see how to go about appealing in the event he suceeds.
    I’m slightly confused as to which category I fall into,
    Am I (d) or am I (e) or what is the difference? or can I apply under (j) and state my case orally?
    Otherwise when I appeal, do I just have to stste the reason why and then wait until they ask for more or do I send a long letter detailing all the issues when I make the appeal?

    Sorry about the delay getting back, I’ve been away from a computer for the last couple of days, thanks again to all who offered advice I’m very grateful.

    Were you notified of the further information submitted?

    Not a word, since we submitted our comments we have heard nothing from the PA, the only reason we knew it had been sent for further information was because I rang to enquire what had happened. Likewise the only reason I knew he’d come back with some further information was because I went to have a look at the file. Surely the PA should be keeping us informed of whats happening?

    Theyre not even that good at updating their website, its hard to find anything and a lot of it is out of date, they told me that theyre not resposible for that as someone else does it for them.

    So does this mean that if they (the PA) want to grant permission to a development that contradicts the development plan, they have to place a notice in a paper, write to everyone who commented on the application and then ask the elected council members to vote to approve this deviation from the Development Plan? As a commentor (objector) to the original application would I then have to make a new or further comment (objection) on their plans to deviate from the DP?

    Also in my case when I made my comments on the application in question I (and seperate others) stated that in my (our) opinion this development would contravene specific named sections of the DP for various reasons, but who exactly would decide if we were correct in our assertions?
    What for example if the PA decided that they didn’t agree that the DP would be contravened?
    Do we have any means of appeal or independant review?

    Thanks for that, what happens in a case where the granting of permission would contravene one or two sections of the town development plan? Can the Planning officials just go ahead and grant permission or would the elected representatives have to give the go ahead for this to happen?

    Where are you? Is it rural or suburban? Does your planning authority have a development plan? If so go and look at it, you may even find it online. Some PAs have it online some don’t.
    I’ve had to object to a planning application recently (Fingal Council).

    Which Ombudsman? Is there a seperate one for dealing with Planning Matters?
    Where would I find him? Does he have a website for example?

    Thanks for that, the area is Navan and covered by Navan “Urban” District council so I’m guessing its Urban, I’ll do a search for the other. Its not me planning by the way but objecting, I’ve found an error in the application which should have invalidated it, the council says its too late now, they are still considering permission. I’m requestiing they invalidate it now I’ve pointed it out, they say they don’t have the power.
    If you can think of anything else I can do or should know please let me know.

    Edit: Just searched whole forum but could’nt find anything….
