What to do if the PA is late?

ParticipantThe planning authority took almost 9 weeks before rejecting my application. The application was valid and no FI was sought. By law I think they had to give a decision within 8 weeks or the decision would be granted by default.
Is this still the case?

InactiveDid the Authority acknowledge receipt of the application prior to the 9 weeks ?. Please refer to Part III S.34 of the planning and development act 2000.

InactiveThe application was accepted on 19/10/07 and the due date was 13/12/07. The decision was given on 18/12/07.

Inactivewhen you say ‘given’ do you mean when you actually received the decision??
The LA have 3 working days from the date of decision to get the decision to the applicant, .. the 13th of December was a Thursday… 3 working days from then is Tuesday 18th December.. the date you recieved the decision…
So i read the situation as being legally OK from the LAs point of view.

InactiveI tought the burden to “get” the decision “to” the applicant was scrapped – is this not so ? The decision exists outright does it not . Makes sense in this information age
