ParticipantIs there provision under the Planning Acts for a private individual to take court action against a developer that has carried out unauthorised development.
I am referring to an action by a private individual as distinct from any action by the PA.

Section 160 the Planning and Development Act-read the whole Part on enforcement /unauthorised development. You would need very deep pockets-it involves seeking a High Court injunction and i only know of its theoretical application rather than any actual examples of its use by a citizen (would be interested to hear of any cases of its use), it may have been used in the Archers Garage demolition in Dublin c.2001 but I am not sure if that was the corpo or a concerned individual.
Seek proper legal advice and an understanding bank manager!
