yes
unless the floor plate at entry level is less than 45sqm when you can drop down to an ambulant loo

The regulation is framed in such a way to allow you argue both ways.

really? never seen that – I have always put the accessible wc at entry level in a duplex. Mind you, I always make the upstairs bathroom accessible too.
Unless you’ve no habitable rooms at entry level in which case the toilet goes on the same floor as the living room. Usually the 45sqm rule helps in duplexes
