Query regarding Planning Permission Status

ParticipantHi Guys, just a quick question. I am looking at a property in the Dun Laoghaire / Rathdown borough, that is a residential house but has been used as a Solicitors office for the past six years. It never got planning permission for change of use from residential to commercial. It is in an area zoned residential. The neighbouring properties are part residential and part commercial, however I cannot establish if those commercial have ever got planning either. Would it be safe to assume this can now be used as commercial without change of use as the current solicitor has used is as this for 6 years or more? If he were to provide an Affadavid to say this would that exempt the next owner?

InactiveBrian I would imagine the properties are all residential.
You are entitled to run a business from your home as long as the property is your address.
You would naturally be required to keep part of the property as residential (perhaps 50%).
What would be difficult would be to rent out the premises as a commercial venture.you need to check with dlrcc to see what the zoning of the area is, if it is to encourage employment or mixed uses this would be good, and if other properties in the zone have been sucessful in planning application for commercial then that would be encouraging.
you will also get an idea of any restriction the council will impose on the planning application and the kind of cost involved, by that I mean you will get an idea of the standard of design and any levle of detail they will want, architects drawings etc.
You would also then be liable to pay rates on the property.A sucessful change in planning permission should be reflected in the value of the property as it can then be let on a commercial lease.
If the residential nature of the property doesnt suit you then I would suggest that this kind of property is not gonna be suitable for you.
