Where would I find the info regarding building across public rights of way?
The site in question is bounded on one side by what looks like it was once a footpath of some sort. Its now overgrown a bit and disused but its still shown on the maps at the land registry office. I presume its public land. The developer in question now wants to build on the site it ajoins and in fact wants ‘annexe’ it to use as the entrance to his proposed new development.
As I said its quite overgrown but its pretty and has a number of mature trees on it some of which are actually shown on the town councils development plan as to be be preserved.
Is there anything preventing him from building across it? Can the council just give him the land? Where can I find the regulations regarding this?
