      just wondering if there is anyone else out there in a similar situation or who have come accross this senario. myself and my husband are preparing our paperwork for planning permission. we previously owned a house which we sold due to financial difficulty. we have been advised by local county councellors etc to just lie on our local needs form and say we didin’t own one, we were not comfortable with this and so have been honest about it and had our pre planning clinic, they told us it would be very difficult to prove our case as we never fell behind in our mortgage repayments , we were very carefull about this and avoided it by borrowing from credit union, family etc on a weekly basis to keep us afloat. eventually it got to the stage where there just was no more access to funds we were in debt to everyone and we had to sell. we have been on the council housing list for 3 years and are now in a position to build, we were offeered a site and so we are now seeking permission. we’re from the area has loads off social and family and employment links and are renting rurally beside the site

      has anyone out there been in this situation or known of a similar case and if so whats the best way to approach it. we can’t get any answers from anyone? we are in meath

      Well, what’s the worst that happen, you get refused and they give you the reasons why, so you’ll know if they can be overcome or not. and you can always appeal or re-submit.

      You can basically try and address the Council’s requirements, address the central ‘need’ issue some how, maybe you need a lawyer or planning consultant to put forward an argument as to why you technically meet the ‘need’ policy in the relevant Development Plan policy. professional advice costs money of course!

      I suggest that if you put in an application to include a strong submission with a rationale as to how you meet the need requirement i.e. you technically didn’t own the house for long enough / were forced to sell and thus currently have a need…I really don’t know…

      thats a good way to look at it, apply and see what they say. we are getting an affidavitt from our solicitor along with bank statements and loan statements etc, we’re hoping this will be enough to prove the sale of our property was due to financial reasons. anyone else we talk to has never come accross this situation, of coarse we know loads of people who had and still have property that have applied for planning and been granted, people who have not been in financial difficulty and who just lied on their applications! it’s so frustrating!thanks for your views on it, every little helps 🙂

      Is it totally impossible to buy an already existing house – trade down or whatever?

      pretty much, you can’t trade down from a mobile home! thats where we’ve been living for the last 3years. the area we live in has no ‘affordable’ property your looking at 600k minimum for a small bungalow. this is the only way for us to provide ourselves with a property which we can afford in the are we are both from.
