    dermot lacey put in an emergency motion, but it was lost!. at 9 mins

    a couple of minutes later he asked for the report to be given to the finance committee,and info on the 185milion, the city managers then says he hasn’t read the report, but he will forward to the finance committee on thursday.

    he hasn’t read the report , that’s an extraordinary admission.

    He meant he had not read the report in the Examiner that morning….

    However, I look forward to reading the minutes of the finance SPC …

    Anyone know if a tram is a vehicle subject to the roads act?

    Roads Act 1993
    71.—(1) ( a ) Any person who, without lawful authority or the consent of a road authority—

    (i) erects, places or retains a sign on a public road, or

    (ii) erects, places or retains on a public road any caravan, vehicle or other structure or thing (whether on wheels or not) used for the purposes of advertising, the sale of goods, the provision of services or other similar purpose,

    shall be guilty of an offence.

    ( b ) A consent under paragraph (a) may be given by the road authority subject to such conditions, restrictions or requirements as it thinks fit and any person who fails to comply with such conditions, restrictions or requirements shall be guilty of an offence.

    (2) Without prejudice to the liability of any person under subsection (1), where there is a contravention of that subsection in the case of any sign or advertisement, the person on whose behalf the sign or advertisement is exhibited shall be deemed also to have contravened that subsection.

    Where does that leave buses I wonder?

    Those rules apply only when the vehicle is static i.e. covering a bus and leaving it at the side of the road would be illegal (and stuck in traffic doesn’t count) – if it’s in motion then its fine

    So are they legal when driven, but illegal when parked?

    However, a degree of transparency is finally expected following a decision last week to expose the details of the contract to an independent audit committee at Dublin City Council.

    Amongst those charged with examining the agreement are senior figures at UCD, DIT and the Chartered Institute of Public Finance and Accountability.

    Last year a new brand of local authority audit committees were established, allowing independent monitoring of the financial workings of a council under the expert guidance of external committee members.

    Concern over the arrangement led to an application for the contract to be examined by the audit committee.

    Committee members who will examine the deal include Tom McAleese of Chambers Ireland, UCD vice president for capital and commer-
    cial development Eamonn Ceannt, Dublin Institute of Technology president Brian Norton, William Carrie of the Chartered Institute of Public Finance and Accountability and Dublin City
    Councillors Dermot Lacey, Gerry Breen and Michael Donnelly.

    Cllr Lacey, who put forward the application to have the contracts examined, said it was “unsatisfactory that public representatives were left guessing as to the exact nature of the agreement.”

    Across the road from the (permission refused on appeal) Newcomen bridge ‘Metropole’ site, our friends JC Decaux tried to slip 5486/08 (containing TWO ‘Metropoles’) in over Christmas.

    The development consists of the removal of 2 no. advertising structures together with the supporting steels, concrete slab and columns, the demolition of existing walls including boundary walls to allow for the construction of a two storey over basement apartment development consisting of 3 apartments (2 no 1 bedroom apartments and 1 no. 2 bedroom apartment)with terraces and balconies to rear complete with privacy screens. All apartments are accessed via a central yard which also contains 3 no. car parking spaces, bin and bicycles storage all accessed from an entrance on Newcomen Avenue. Also the construction of new boundary walls and a new landscaped public space on North Strand Road with 2 no. Metropole advertising structures.

    I would expect them to try again. They’re obviously very keen to get something up at this location, which is a protected structure.

    From what I see there appears to be a creep creep of these units. Loioks like another appearing on South King Street outside H&M.
    Not a sniff of the proposed signage, bicycles, toilets, heritage plaques either. Nothing!

    By the looks of things, the H&M one was applied for in 2007. Reg. Ref. 1491/07. Presumably there was a bit of a backlog in the erection division of JCDecaux.

    I was trying to formulate a joke about refractory periods and the length of time between the signs appearing, but the appropriate moment for the issuing of such a verbal utterance is not yet upon us.
