ParticipantCan anyone tell me if Bord Pleanal must justify its reasons for contravening a Development Plan and also if they fail to take on the recommendations in their Inspector are they obliged to justify why they ruled against these recommendations?
Secondly, if there are some errors that pertain to the appeal, as in the description of the development that the Bord may have overlooked, is it possible to bring this to their attention, even though they’ve already made their decision?
Thanks a million all. I’m at a dead end here as regards what options remain open to me on a decision that Bord Pleanala made.
I read that following;
An Bord Pleanala considers all appealed planning decisions from the beginning. It does not simply review the decision of a local planning authority. Mechanisms also exist for parties to make submissions based on considerations that arise after the decision has been made.
What exactly does this bold part of this text mean?

like you said they are recommendations. If they had to stick to them 100%, what would be the point it continuing the process further than the inspector.
As for your path to go now, I have no idea. They are people here with a better knowledge than me and will be alone soon if your lucky.
