ParticipantIs anyone familar with a case in Gorey where an appeal to An Bord Pleanála was thrown out as vexatious.

vexatious – instituted without sufficient grounds and serving only to cause annoyance to the defendant
sounds like 90% of all appeals to ABP

InactiveWith hindsight – it was a bad question. If the appeal is thrown out there is only a brief explaination on the BP site – no inspector’s report etc. so it is difficult to get a handle on what consitutes a precendent. In the case I am aware of an appeal was lodged against a development by a person on the other side of the country against a development where there is no evidence of them even viewing the file. The appellant is allegedly a good freind of a rival of the proposed development who stands to gain a business advantage even if the development is delayed – difficult to prove though.
