Demolition of front garden wall

Hi, does removal of a front boundary wall (of less than 1.2m), without reinstatement constitute exempt development? the house itself is approx. 50 years old and the council have issued a letter requesting that a declaration of exempted development or retention be sought. Is there anything in the regulations that we can go back to council with to basically say that an enforcement should not be applied here?

Have you been using the garden for parking at all since you removed the wall?

As per Planning & Development Regs 2001, exempted development only applies to the construction of a wall, and not the demolition. Not that that stops a lot of people doing it!

However local councils are particularly touchy about widening driveway entrances for parking. Best course of action would be to discuss with them what they would be agreeable to.
